    Rachel Rohr has practised exclusively in family law since she was licensed by the Law Society of Ontario in March 2021. She articled and summered at Toronto family law firms, large and small, and earned her J.D. at the University of Windsor. Before law school, she worked for several years as a law clerk to Barry Carmichael.

    Rachel represents clients from Oshawa, Whitby, Ajax, Pickering and Clarington in negotiation, mediation and family court at the Durham Region courthouse in Oshawa.     Child support is set mainly by the paying parent’s annual income and the number of children, using the tables in the Child Support Guidelines. Parents may also share special expenses such as child care and activities. Support can be changed when income or parenting time changes.
    Entitlement depends on the length of the relationship, each person’s roles and income, and any financial disadvantage from the relationship. If entitlement exists, the Spousal Support Advisory Guidelines usually guide the amount and duration. Married and some common-law spouses can qualify.
    No, not automatically. Ontario’s equalization rules apply only to married spouses. A common-law partner who contributed to property owned by the other may still have a trust or unjust enrichment claim. A cohabitation agreement can set out rights in advance.

    In most cases, yes. Under the Divorce Act, the usual ground is living separate and apart for at least one year. You can start the application during that year. Adultery or cruelty are also grounds, but they are used far less often.

    A contested case that goes through conferences and motions at the Oshawa courthouse often takes one to two years, and longer if it goes to trial. Many cases settle at or after the case conference or settlement conference, which shortens the timeline and the cost.

    The law does not require one, but independent legal advice is strongly recommended. An agreement signed without proper financial disclosure or advice is easier to challenge later. A family lawyer checks that it is fair, complete and enforceable.
